Term Insurance Rejected for non Disclosure

Dear Team,
One of my family member died recently because of Covid-19. He has 1 Crore term insurance in HDFC life. He took policy in 2015.
He has diabetics but at the time of policy Proposal he did not disclose. So, the company rejected the claim. As i know after 3 years of policy inception no claim can be rejected as per Sec.45.
Can we Fight legally against the company?

Firstly, Sorry for your loss.
To answer your question, Yes, under section 45, an insurer cannot reject the claim after the policy has completed 3 years. This is provided all premiums till the event of the policy holder's death were paid on time.
As per my knowledge this can be taken up with IRDA.
